Oh my God, it's Mojo in the morning. I gotta tell you, this is pretty crazy to know this. You know that this weekend is number three on the list of the busiest weekends for the cops writing DUIs.

00:02:14 - 00:02:14 | Speaker 1:

Really?

00:02:14 - 00:02:45 | Speaker 6:

This weekend that we're about to face, which is the weekend, what, two weekends before or Christmas, I think it is, is the number one for the season, for the month, DUI weekend. It's number three on the list. Number one is New Year's that weekend. And number two is St. Patrick's Day weekend for the biggest DUI weekends. And it's because everybody's going to holiday parties at this time of the year.

00:02:45 - 00:02:46 | Speaker 1:

Uber and Lyft.

00:02:46 - 00:03:17 | Speaker 6:

You know what's funny, though? People, for some reason, still don't get it. But this is the problem, though, Shan, is that people think, and I see it so many times, and they're good friends of mine, that they'll have a couple of drinks and they think two drinks doesn't give them a blood alcohol level that's over the legal limit. And here's the problem. The problem is you think you're fine, but the legal limit they made so low because they want to make sure you absolutely are fine. So it's not that you can't control yourself.

00:03:17 - 00:03:20 | Speaker 1:

You might feel okay, but if you're over .08, you're done-zo.

00:03:21 - 00:03:33 | Speaker 6:

Has anybody ever gotten a DUI? Man. Kev, you got one, right? No. No? No. I've been in two drunk driving accidents, and luckily- Did not get a DUI from them. Yeah, we're- That's right. You talked about it on our more local podcast.

00:03:33 - 00:03:38 | Speaker 1:

Coming home from a holiday party, has anybody ever got- Is anybody going home? Your work holiday party?

00:03:38 - 00:04:45 | Speaker 6:

That would be- How embarrassing would it be? Hey, where's Bob at? Bob's not here today. They may know where Bob's at. Bob's hanging out at Wayne County. Somebody got to bomb Bob out. 844-MOJO-LIVE, 844-665-6548 is our telephone number. I want to ask a question of a friend. Our friend's from Ticket Fix Pro. Nick is actually on the phone with us right now. Nick, you there, buddy? Nick. What's up, Mojo? What's up, guys? What up, Nick? How you doing, buddy? What's happening, brother? Hey, everyone. Hey, I got to ask you a question. Thank God, and God forbid, I've never gotten a DUI. Never even gotten pulled over by a cop when I've had a drink in my system. So thank God, knock on wood, I'm going to make sure that that doesn't happen. I know there have been times where I've gotten off of a golf course a few hours after golfing, and I've had drinks on the golf course. I probably shouldn't have gotten behind the wheel. But I want to ask you a question. When you get pulled over by the police, that incident takes place, the moment that it takes place, those cops, is it that they sense that you are drunk or they smell that you possibly have had alcohol or both?

00:04:45 - 00:04:59 | Speaker 7:

You know, a lot of times at that time of the day, like you just said, people are coming home from holiday parties. They know they're out there looking for that person who's just doing one thing wrong. They might pull you over for speeding. They might pull you over for going.

00:05:00 - 00:05:20 | Speaker 2:

over the line they say or swerving or whatever you're doing texting and driving right and then they're just going to ask you have you had anything to drink 99 of everybody just says yeah i only had a couple of drinks i had a drink a couple hours ago as soon as they do that they just admitted to drinking and driving without even realizing they admitted to it wow so even even just being

00:05:20 - 00:05:30 | Speaker 1:

honest so so nick if so if you are somebody that gets pulled over and you may have had a drink earlier in the evening what you should not say something like that you shouldn't say yeah i drank

00:05:30 - 00:05:42 | Speaker 2:

of course once you do you're admitting you're admitting that you drank and you're giving improbable cause to pull you pull you out of the vehicle do sobriety tests on you so no you

00:05:42 - 00:05:55 | Speaker 3:

shouldn't admit to it but once you say you haven't and then they do the tests and they do the blood alcohol whatever then can you get charged with lying to a cop no no i mean you know

00:05:55 - 00:06:18 | Speaker 2:

listen here's the thing you have the right to to not incriminate yourself so you know you don't have to you have the right to remain silent that whole time you could just crack your window and just hand him your id but that's going to make things even more awkward you know when people do that but you technically could just crack the window and hand him your id and be like here write me my speeding ticket but the common person doesn't know to go do all that you know what i

00:06:18 - 00:06:31 | Speaker 1:

mean hey nick so when you do get asked to do the test like if they say to you hey come out of the car step out of the car are they're asking you to do like a roadside sobriety test what should you

00:06:31 - 00:07:24 | Speaker 2:

do in a case like that well you could take the test or you could refuse the test if you refuse the test on on this on the scene it's just a civil infraction but if they do take you to jail and you end up refusing that second test that they do, then at that point, they can suspend your license for up to a year. Wow. So you got to be careful with doing that. But if you're on the scene, if you're on the site, the PBT test that they do on the road, that's the civil infraction if you refuse it. It's the second test that they do after they have the probable cause and they actually arrest you. If you were to refuse that second test, it's considered a refusal. You can lose your license for a year. We appeal those all the time for people, though, and we have 14 days to appeal it. So if someone did do that, they have 14 days or they're going to lose their license for a year with no chance.

00:07:24 - 00:07:25 | Speaker 4:

I think a lot of people know that. Wow.

00:07:25 - 00:07:45 | Speaker 2:

Nick. No, there's so much that people don't know. That's the thing. That's why if you try to go in on this on your own or a lot of times people say, you know, let me just get a court appointed attorney. Those guys have 75 cases that they're working on that they don't they're getting paid $100 to do. and they don't really give their clients the time that's needed to really explain this stuff to them. I mean, this is serious stuff.

00:07:46 - 00:08:06 | Speaker 1:

Nick from TicketFixPro.com is on with us right now. Nick, I want to ask you one last question because I don't even know what this is. If you get taken back to the police station, they do a test on you, and the test comes back that you are over the legal limit. Are you in jail right away? You're instantly, and you have to stay there for a certain amount of time?

00:08:06 - 00:08:35 | Speaker 2:

so what most police departments do they they do have to leave you there for to sober up so there is a time that they'll have to leave you there at least 12 hours to try to sober up so that they don't want to release you and then you hurt yourself again or something happens so you're in their responsibility at that point so they will let you do that and a lot of them will just release you and say you know you'll receive a court date in the mail or if it's like a weekday they might take you to court the next day and have you arraigned in front of a magistrate and set a

00:08:35 - 00:08:59 | Speaker 1:

bond and all that stuff. Wow. All right. Ticketfixpro.com on with us right now. This is the third biggest weekend of the year to New Year's and St. Patrick's Day this weekend right here for getting DUIs. Rachel, what's up? It's Mojo in the morning. What's going on? Hey, Mojo. Hey, what's going on, Rachel? We were talking about how people think that they're fine after one drink or maybe two drinks. Tell everybody what you got a DUI after drinking.

00:08:59 - 00:09:15 | Speaker 4:

so i had one drink one shot i ate and everything thought i was good actually got sick got pulled over and still blew a 0.1 come to find out i had had gastric bypass and my body was not processing

00:09:15 - 00:09:25 | Speaker 1:

the alcohol interesting wow which potentially obviously leads to the dui and that's where of course you're having to hire an attorney like ticketfixpro.com to to help you get out of this

00:09:25 - 00:09:37 | Speaker 4:

whole thing yep and even when i sat in the cell and i had to wait even in the morning after waiting all those hours i was still over the legal limit off one drink in one shot wow that that is unreal

00:09:37 - 00:09:53 | Speaker 1:

and you don't even think about that and a lot of times people are taking those ozempic shots uh or you know any kind of those peptide thingies or whatever uh and you could be over the legal limit because of your system uh and the and what the shot's doing to you victoria what did you get a DUI or Driving Under the Influence

00:09:53 - 00:10:00 | Speaker 4:

for? Good morning, everyone. Good morning. Handful of years ago, this was back in...

00:10:00 - 00:10:30 | Speaker 2:

2017 um i had been smoking a little bit and went for a drive i was with my ex-boyfriend um just taking a little smoke cruise you know um i had a cop or a car behind me for a minute didn't think anything of it driving was totally fine pulls me over because i had a license plate light out um smelled weed macked me with the dui um it's all over everything's great now life is

00:10:30 - 00:10:35 | Speaker 6:

good didn't affect me nick are you seeing more more and more people getting uh under the influence

00:10:35 - 00:10:49 | Speaker 7:

because of of weed definitely i mean that's a big thing for state police you know they're trying to stop people they they call it uh they call it button uh high driving or whatever you know

00:10:49 - 00:10:54 | Speaker 6:

Yeah, and it's happening more often, and you're seeing it more on the highways, I guess, huh, where people are just driving?

00:10:55 - 00:11:53 | Speaker 7:

Drug driving. That's what they call it. D-R-U-G-G-E-D. Drug driving versus drunk driving. It's the same thing. If they catch you smoking a joint and driving, they can say you were impaired. But here's the thing. With Michigan, we have medical marijuana patients. People are allowed to have it in their system, so that gets a little bit interesting right there. i beat a case where they pulled the kid over for having the kid had literally had a seizure and he got stopped in the middle of the road to destroy police they pull him out of the car while he's having a seizure they check his pocket they say oh he has a vape he's high because he had the vape so we actually took the case to trial and we won the case because uh the the the prosecutor we say you know what we're going to take the trial this kid wasn't high he had a seizure so they tried to blame it on that because but what if you have a medical marijuana car in michigan You can have it in your system, and they have to prove that you are substantially impaired. Wow. That's why you have to call TicketFixPro.

00:11:53 - 00:12:04 | Speaker 6:

TicketFixPro.com. Nick, I appreciate you going on with us, man. Have a very Merry Christmas. I mean, I hate to say this. I hope you don't have a very busy weekend. I hope people are smart enough to not be doing this.

00:12:04 - 00:12:24 | Speaker 7:

We want people to stay safe. Of course, that's not, you know, we don't want people. We have to deal, unfortunately, with people's downfall, but we're here to help them and pick them back up like this lady that just said she's moved on with her life. By the way, you could expunge a DUI now after five years, so if you do have it on your record and you want it off, we could expunge it off if you haven't had any other DUI

00:12:24 - 00:12:36 | Speaker 6:

since then. Yeah, and a lot of times DUIs will keep you from getting any kind of a job or possibly any kind of a better license than the license that you have. Ticketvixpro.com. Ice Cube's
